Jammu & Kashmir: Between Borders and Broken Promises

The Government of India under Prime Minister Narendra Modi and Home Minister Amit Shah, has removed erstwhile statehood to Jammu and Kashmir on August 5 and 6, 2019, further downsizing it into union territory. Jammu and Kashmir was bifurcated and cut into two UT's of Jammu Kashmir and Ladakh giving people of Jammu and Kashmir a big jolt and rendering them orphaned and at the mercy of the center government and the rule of LG representative of central government. Hence in fact a very severe body blow was given to the political parties and other people. Regional mainstream parties, national party Congress, SP and other other parties and people of Jammu and Kashmir demand bringing back the statehood at earliest but the center in no hurry to take Jammu and Kashmir back to statehood and give justice to the people who have dis-empowered the divestment of Reorganizational Act 2019.                                    

Regional political parties, several national political parties belonging to the opposition, and last but not least the most affected people of Jammu and Kashmir from the day one of downsizing of the erstwhile state of Jammu and Kashmir, have been demanding statehood restoration from day one. Centre government seems to be unmoved and last in taking any concrete decision to restore statehood to J&K soon. Clearly, centre government seems not convinced to restore statehood to Jammu and Kashmir, it is simply lingering this important and public issue and is not initiating any efforts to grant statehood to Jammu and Kashmir which obviously it owes to people of Jammu and Kashmir; thus, statehood needs to be granted to the erstwhile state sooner than later in order to heal and help ease the wounds, bruises and most importantly mental (psychic) injury of its most abused peoples, whose statehood and identity (status) was stolen from them and snatched from them in August, 2019 and hand down by Modi's central government. But virtually everyday since the repealing of Jammu and Kashmir's statehood has occurred, the high profile leaders and often their entire party with them, like PM Modi and HM Amit Shah have expressed multiple times a serious commitment that statehood will be restored to Jammu and Kashmir, however, they come up short on giving the timing or specific date under when Jammu and Kashmir will be endowed with restoration of its statehood. PM Modi and HM Amit Shah also repeat ad nauseam that statehood will be bestowed upon upon Jammu and Kashmir at an appropriate and opportune time, yet failed still to give any timeline or point in time in which the people of Jammu and Kashmir are restored their statehood. NC, PDP, AP, AAP, CPI(M), PC, and others including the Congress party all demand statehood restoration to help provide some comfort to the orphaned people in Jammu and Kashmir, yet are always provided the same meaningless gesture of hand that the federal government is committed to restoring statehood at the appropriate time. HM Amit Shah more recently argued to say that Jammu and Kashmir will achieve restore statehood, yet too said, no date at certain date can be determined or given, in respect to Jammu and Kashmir being restored statehood. 

He also stated that there are a variety of factors and indicators that must be reviewed prior to a real decision being made concerning the restoration of statehood to J&K. Thus, a considerable amount of uncertainty exists about the timeframe in which statehood will actually be restored to the former state. The actual and real victims of the statehood downsizing are the people of this region, since they are the ones who suffer the most and face inconveniences from having their statehood snatched away from them. Apart from the people, it is the regional political parties as well as national political parties who are all focused on what to do due to the downsizing of statehood experiences it loses benefit from statehood in this region. Thus, in order to gain the people's trust, confidence, and love in the people of J&K statehood must be restored much sooner than later, so that they would feel some comfort and mitigate the misconception that the Chief minister powers were being given to them and his councils of ministers. However, it is abundantly clear that Modi's government is in no rush to restore statehood to Jammu and Kashmir.

There are several instances regarding the transition of a UT into an actual state, and, while there is ample instance of transitioning a UT into a state in independent India, there is no previous instance of an actual state being taken down to a UT. Therefore, it is politically unreasonable and untenable to take a state to a UT. It goes against democratic standards, values and principles of justice and good administration and governance that J&K miraculously went from a state to two UT's at one time through parliament legislation. The Re Organization Act 2019 dis-empowered broadly the K&J government, cabinet, MLA's and thus the people of J&K as the ultimate beneficiaries of authority. Our elected (now) government headed by the Chief Minister Omar Abdullah with his new cabinet of ministers, MLA's and therefore the people have been dis-empowered. The LG has been vested enough legislation, executive and administrative powers that the elected UT government is left with very few powers.

For even the mundane matters files have to be routed to the LG who is almighty. AIMIM chief Owasi has ridiculed Omar Abdullah saying he has no powers even to appoint a peon. There is much ambiguity, overlapping and duplication of powers between the duly elected government, its chief ministers, its ministers and the all mighty LG. Even powers are on their sides, the all mighty LG leaves little powers for the duly elected government. Powers have crossed the limits between LG and chief minister, which give rise to friction, tussle and conflict after the transfer of 48 JKAS officers directly made by the LG and no prior consultation with the chief minister. CM Omar Abdullah has written a letter to the prime minister about these transfers and even demanded clear powers to the elected government for effective governance and administration of Jammu and Kashmir.

It is incumbent upon the Modi government to follow the demand of the people and political parties as well as that of the NC-Congress alliance government and restore the statehood to the people of Jammu and Kashmir forthwith and immediately so that the balm is given to the wounds of the people and they feel a sense of belonging and trust, considered by the people of Jammu and Kashmir into a sense of belongingness and trust, confidence and love of the people of Jammu and Kashmir. To rid the people of Jammu and Kashmir of this alienation, they must be given statehood immediately, without any delay. The decision of the restoration of statehood to J&K will be rightly in the benefit of the people of J&K and the whole of India. The sooner they do it, the better. The decision to restore statehood to Jammu and Kashmir will be welcome by the political parties and the gullible people of Jammu and Kashmir and most importantly restore statehood to J&K will fortify the idea of living in a federal state and policy in the federal character of the Indian Nation. This decision will be the true victory of democracy and federalism. All eyes on set on the central government and it is the earnest and sincere appeal of the people of J&K to NDA government to restore the statehood to JK at earliest.
